Privacy Notice

This document constitutes the Privacy Notice for the purposes of the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals and the provisions that emanate from it or are related to it.

This Privacy Notice applies to personal information collected about the Data Subject by PANORAMA WORKS, S.C., in its capacity as Responsible. This Privacy Notice has the following terms and conditions:

1. DEFINITION OF TERMS:

For the purposes of this Notice and in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties, the following definitions shall apply: Privacy Notice: Physical, electronic document generated by the responsible party that is made available to the holder, prior to the processing of their personal data. Personal Data: Any information concerning an identified or identifiable natural person. Sensitive Personal Data: Any personal data that affects the most intimate sphere of its owner or whose improper use may give rise to discrimination or entail a serious risk to the owner. ARCO Rights: Means the rights of Access, Rectification, Cancellation and Opposition that in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals and subject to the exceptions established therein and in this Privacy Notice, each Data Subject has in relation to the Personal Data collected by the Controller and/or its Processors, and which are described below: Right of Access: This is the right of the Data Subject to know about the Personal Data related to him/her that is held by the Controller in question or its Processors, as well as to whom it has been shared and for what purpose. Right to Rectification: Each Data Subject has the right to have his or her Personal Data rectified when they are inaccurate or incomplete. Right of Cancellation: Each Data Subject has the right to request at any time that his or her Personal Data be deleted, which will happen once the blocking period has elapsed. The blocking implies the identification and preservation of the Personal Data, once the purpose for which it was collected is fulfilled, and its purpose is to determine the possible liabilities in relation to its processing, until the legal or contractual prescription period of these. During this period, your Personal Data will not be processed and once this period has elapsed, it will be deleted from the corresponding database or file. Once the corresponding data has been cancelled, the Controller shall provide the Data Subject with the corresponding notice. In the event that the Personal Data had been transmitted prior to the date of rectification or cancellation and continue to be processed by third parties, the Controller shall inform the third party in question of the request for rectification or cancellation, so that it may also proceed to carry it out. Right of Opposition: The Data Subject has at all times the right to request, provided that he/she has a legitimate cause, that the Controller stops processing his/her Personal Data. Controller: Means the natural or legal person who decides on the processing of Personal Data of the Data Subject, in this case PANORAMA WORKS, S.C. Processor: Means the natural or legal person who alone or jointly with others processes Personal Data on behalf of the Controller. Data Controller: Means the natural person who is the owner of the Personal Data, or authorized to provide Personal Data of a third party in accordance with applicable laws, who provides such Personal Data to the Controller.

2. CONSENT OF THE HOLDER

For the purposes of the provisions of Article 17 of the Federal Law for the Protection of Personal Data in Possession of Individuals, the Data Controller declares that: I. II. Have read, understood and agreed to the terms set forth in this Privacy Notice, and therefore give their consent regarding the processing of their Personal Data for the purposes of the Federal Law on Protection of Personal Data Held by Private Parties and other applicable legislation. In the event that the Personal Data collected includes sensitive or financial Personal Data, by signing the corresponding contract, either in printed format, or using electronic means and its corresponding processes for the formation of consent, for example, by way of example but not limited to, the provision of Personal Data through the dialogue windows, or the display and display on screen of terms and conditions, acts that constitute the express consent of the owner in terms of the second paragraph of Article 8 of the Federal Law for the Protection of Personal Data Held by Private Parties and other applicable legislation and III. That you give your consent for PANORAMA WORKS, S.C. or its Agents to transfer your Personal Data to national or foreign third parties, with the understanding that the treatment that such third parties give to your Personal Data must comply with the provisions of this Privacy Notice. In the event that the Data Subject does not object to the terms of this Privacy Notice within the following 48 hours in which it was made available to him/her, its content shall be deemed agreed and consented to, in terms of the third paragraph of article 8 of the Federal Law for the Protection of Personal Data in Possession of Individuals. The consent of the Data Subject may be revoked at any time by the Data Subject without retroactive effect, under the terms and in accordance with the procedures established below for this purpose under this Privacy Notice. Notwithstanding any provision of this Privacy Notice, the Data Subject acknowledges that his or her consent shall not be required for the processing of Personal Data by the Controller or third parties in any of the cases set forth in Article 10 of the Federal Law on the Protection of Personal Data Held by Private Parties.

3. PURPOSE OF THE PRIVACY NOTICE; PURPOSE OF THE PERSONAL DATA.

The purpose of this Privacy Notice is to establish the terms and conditions under which PANORAMA WORKS, S.C., or the person in charge appointed by it: I. Receive and protect the Personal Data of the Data Subject, in order to protect their privacy and their right to informational self-determination, in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties; II. Use the Personal Data of the Data Subject, and III. Perform, where appropriate, the transfers of Personal Data to third parties. The Controller shall collect and process the Personal Data of the Data Subject, that is to say, that information that can reasonably identify him/her, through the receipt of documents, whether in printed and/or digital format. The following are examples, by way of example but not limitation, of information that the Controller may collect: name and surname; home, work or tax address; personal or work e-mail address; home or work telephone number; mobile phone number; Federal Taxpayers' Register (RFC) code. The collection of Personal Data may be carried out through direct delivery to the Controller or through the use of e-mails and/or through the use of its Web sites, through the voluntary provision of information through the dialogue windows enabled on the sites, or through the use of automatic data capture tools. Such tools allow it to collect information sent by your browser to those websites, such as the type of browser you use, user language, access times, and the IP address of websites you used to access the Responsible or Entrusted sites. The Controller may also collect Personal Data from publicly available sources and from other commercially available sources to which the Data Subject may have consented to the sharing of his or her personal information or which have provided him or her with anonymous demographic information associated with a particular geographic area.

4. PROTECTION AND SECURITY OF PERSONAL DATA.

The Controller and/or its Agents shall keep the Personal Data of the Data Subject for the time necessary to process their requests for information, products and/or services, as well as to maintain the accounting, financial and audit records in terms of the Federal Law for the Protection of Personal Data in Possession of Individuals and the current mercantile, fiscal and administrative legislation. The Personal Data of the Data Subject collected by the Controller and/or its Agents shall be protected by appropriate administrative, technical and physical security measures against damage, loss, alteration, destruction or unauthorized use, access or processing, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties and the administrative regulations derived therefrom. Notwithstanding the foregoing, PANORAMA WORKS, S.C. does not guarantee that unauthorized third parties can not access the physical or logical systems of the Holders or the Controller or electronic documents and files stored in their systems. Consequently PANORAMA WORKS, S.C. will in no case be liable for any damages that may arise from such unauthorised access.

For the purposes of the provisions of Section I of Article 16 of the Federal Law on the Protection of Personal Data Held by Private Parties, the address of the Controller is that established in this Section 5 of this Privacy Notice.

6. PROCEDURE FOR EXERCISING RIGHTS ARC.

In order to exercise the ARCO Rights, the Data Subject or his/her representative must submit a request for access, rectification, cancellation or opposition with the following information and documentation: I) Name of the Data Subject and address or other means to communicate the response to his/her request; II) The documents proving his/her identity (simple copy in printed or electronic format of his/her voter's credential, passport or FM-2 or FM-3) or, if applicable, the legal representation of the Data Subject (simple copy in printed or electronic format of the simple power of attorney with autographic signature of the Data Subject, the representative and their corresponding official IDs - (voter's credential, passport, FM-2 or FM- 3); III) The clear and precise description of the Personal Data in respect of which the Data Subject seeks to exercise any of the ARCO Rights, and IV) Any other element or document that facilitates the location of the Personal Data of the Data Subject. In the case of requests for rectification of Personal Data, the respective Data Subject shall also indicate the modifications to be made and provide the documentation supporting his or her request. For the reception, registration and attention of requests to exercise your right of access, rectification, cancellation and opposition to your Personal Data, as well as to limit the use or disclosure of your data, and the other rights provided for in the Federal Law on Protection of Personal Data Held by Private Parties, please contact us at E-mail address: [hola@panorama.works]. The Controller or its Agents will respond to the respective Data Subject within a maximum period of twenty working days, counted from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted, so that, if it is appropriate, the same becomes effective within the fifteen days following the date on which the response is communicated to the Data Subject. In the case of requests for access to Personal Data, the Controller or its Processors shall proceed with the delivery thereof upon accreditation of the identity of the applicant or his legal representative, as the case may be. The aforementioned deadlines may be extended only in terms of the Federal Law for the Protection of Personal Data in Possession of Individuals. The delivery of the Personal Data shall be free of charge, and you shall only be responsible for covering the justified shipping costs or the cost of reproduction in copies or other formats. In the event that the Data Subject reiterates his/her request in a period of less than twelve months, he/she shall cover the corresponding costs equivalent to 1.5 days of the Minimum Wage in Force in the Federal District in terms of the Federal Law for the Protection of Personal Data in Possession of Individuals, unless there are substantial modifications to the Privacy Notice that motivate new consultations. For the purposes of requests for cancellation of Personal Data, in addition to the provisions of this Privacy Notice, the provisions of Article 26 of the Federal Law for the Protection of Personal Data in Possession of Individuals shall apply, including the cases of exception for the cancellation of Personal Data indicated. The submission of a request of opposition to the use of Personal Data by the Data Subject shall give the Controller the right to oppose the use of the Personal Data that the Data Subject has provided to the objector.

7. CHANGES TO THE PRIVACY NOTICE.

PANORAMA WORKS, S.C. reserves the right to periodically update this Notice to reflect changes in our information practices. It is the responsibility of the Holder to periodically review the content of the Privacy Notice on the site [www.panorama.works]. The Data Controller understands that if not otherwise expressed, it means that the Data Subject has read, understood and agreed to the terms set forth, which constitutes consent to the changes set forth in such updates regarding the processing of their Personal Data for the purposes of the Federal Law on Protection of Personal Data Held by Private Parties and other applicable laws.
